What does Florida law say about sports betting?
Florida law authorizes the Seminole Tribe of Florida to conduct sports betting under its gaming compact, including wagers placed from a mobile device by players physically in Florida, deemed to be conducted at the Tribe's servers on its lands. Source: Florida Statutes, section 285.710, checked October 6, 2026.
- Legal status. The Florida Gaming Control Commission's FAQ says that unless a wager is placed through sportsbooks operated by or in conjunction with the Seminole Tribe, it is most likely an illegal wager, even if the sportsbook is licensed in another state. Source: Florida Gaming Control Commission, FAQ, checked October 6, 2026.
- Regulator. Under section 285.710, the Florida Gaming Control Commission is the state compliance agency with authority to carry out the state's oversight responsibilities under the Seminole gaming compact. Source: Florida Statutes, section 285.710, checked October 6, 2026.
- Minimum age. Section 285.710 of the Florida Statutes requires a person to be 21 or older to wager on sports betting. Source: Florida Statutes, section 285.710, checked October 6, 2026.
- Tax and licensing. A Florida Senate staff analysis (May 2021) of the Seminole compact says the Tribe pays the state 13.75% of net win from sports betting it markets itself and 10% of net win marketed by pari-mutuel permitholders, within a $2.5 billion minimum total payment over the first five years. Source: Florida Senate, Bill Analysis and Fiscal Impact Statement, CS/SB 2-A (2021 Gaming Compact), checked October 6, 2026.
- In-person and tribal rules. Under the 2021 Seminole compact the Tribe is the exclusive sportsbook operator but must offer marketing contracts to willing qualified pari-mutuel permitholders, who earn at least 60% of the profit on bets via their branded apps; total payments are capped at 40% of the Tribe's sports net win.
