What courts and officials have done about exchanges in Nevada

  • On Aug. 28, 2026, a three-judge Ninth Circuit panel upheld the order that had dissolved Kalshi's preliminary injunction against the Nevada Gaming Control Board, finding Kalshi had not shown federal law likely preempts Nevada gaming rules for its sports contracts. Kalshi said it would seek further review. Source: The Block, checked October 6, 2026.
  • Kalshi petitioned the full Ninth Circuit on Sept. 9, 2026 to rehear the Nevada decision, citing a conflict with an April 2026 Third Circuit ruling. No decision on the petition had been reported by mid-September 2026, so the Nevada question remains contested. Source: Covers, checked October 6, 2026.
